By accessing and using Burner Outpost, you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these terms, please do not use our service.
2. Description of Service
Burner Outpost is a marketplace platform that connects members of the Burning Man community to buy, sell, rent, and trade gear, services, and accommodations. We provide the platform but do not own, create, sell, or control the listings posted by users.
3. User Responsibilities
Users agree to:
- Provide accurate and truthful information in all listings and communications
- Honor all commitments made through the platform
- Comply with all applicable local, state, and federal laws
- Respect other community members and maintain civil discourse
- Not use the platform for fraudulent or illegal activities
- Not post prohibited items including weapons, drugs, or stolen goods
- Maintain the security and confidentiality of their account credentials
4. Marketplace Rules
Pricing and Transactions
All prices must be clearly stated in USD. Users are responsible for setting fair prices and honoring listed prices. We encourage the spirit of the gifting economy while recognizing that transactions help facilitate community sustainability.
Item Condition and Description
Sellers must accurately describe the condition of items and provide clear photographs. Misrepresentation of items is grounds for account suspension.
Communication
All initial communication between buyers and sellers should occur through the platform. Users may exchange contact information after establishing a transaction.
5. Intellectual Property
Users retain ownership of content they post but grant Burner Outpost a license to display, distribute, and promote that content on our platform. Users must not post content that infringes on others' intellectual property rights.
6. Liability and Disclaimers
Important Disclaimers:
- Burner Outpost is not party to transactions between users and assumes no liability for disputes, damages, or losses
- Users transact at their own risk. We recommend meeting in public places and using secure payment methods
- We do not verify the identity, credentials, or background of users
- The platform is provided "as is" without warranties of any kind
- We are not responsible for the quality, safety, or legality of items listed
7. Account Termination
We reserve the right to suspend or terminate accounts that violate these terms, engage in fraudulent activity, or harm the community. Users may delete their accounts at any time through their settings.
8. Burning Man Principles
While Burner Outpost facilitates commercial transactions, we encourage users to embody the Ten Principles of Burning Man, including radical self-reliance, gifting, decommodification, and leaving no trace. We strive to support the community's values while providing a practical marketplace.
9. Modifications to Terms
We reserve the right to modify these terms at any time. Users will be notified of significant changes via email or platform notification. Continued use of the platform after changes constitutes acceptance of the modified terms.
10. Governing Law
These terms are governed by the laws of the State of California, USA. Any disputes shall be resolved in the courts of California.
